Dear Counselors, Honorable Judge, and Ohio Attorney General, I am a representative of The Antioch Papers, an independent on-line publication and archive for documentary materials related to the institutional life of Antioch College and Antioch University. The Antioch Papers is a significant higher education resource that has received media coverage from publications such as Inside Higher Ed. The Antioch Papers is requesting a full copy of the Asset Purchase Agreement (APA) between Antioch University and the Antioch College Continuation Corporation (ACCC) entered into on June 30, 2009. We are making this request based on the public’s “right to know” about the recently completed transfer of assets from Antioch University to the ACCC, an event that has received national press attention. The Antioch Papers, like many of Antioch’s alums, donors, and researchers in the field of higher education, believes the principle of the public’s “right to know” is a key foundational element for creating and sustaining an informed and educated public. Public officials have already considered the APA through the public offices of the Ohio Attorney General that approved the APA and the Greene County Probate Court that based a decision in large part on the APA. To date the APA itself has never been made public. This is a formal request to the legal counselors, the Greene County Probate Court, and the Ohio Attorney General to make the full APA public. Please let me know when your office or client will be able to provide the APA so that The Antioch Papers can take the appropriate steps to publish this document at its website.
